Warranty Term1.Duration and scope of Manufacturer's warranty (the "Warranty"):<o:p>
1.1.All new Vehicles are covered by a Warranty under the following conditions:<o:p>
for a duration of one (1) year, including parts and labour, on the Vehicle;<o:p>
for (a) one (1) additional year, including parts and labour, exclusively for the engine, gearbox, axles (b) up to 200,000 km It is however understood and agreed by the Buyer that the Warranty shall terminate upon completion of the earlier of (a) and (b) (mileage or duration).<o:p>
1.2.Vehicles shall be covered by a Warranty, including parts and labour, for a total of five (5) years with regard to cab corrosion. This Warranty shall solely cover damage due to corrosion developing from the inside to the outside of the body of the Vehicles.<o:p>
1.3.The Warranty shall enter into force on the date of first registration of the Vehicles as stipulated on the certificate of registration of the Vehicle and in any case no later than three (3) months after the date of issuance of the corresponding invoice by RT. This Warranty shall only cover parts recognised as defective by RT. This Warranty shall include, at RT's sole and discretionary option, the exchange or repair of the defective parts including the cost of labour required for the said exchange or repair. Under no circumstances shall services provided under the Warranty extend the Warranty term.<o:p>
2.Limitations:<o:p>
Enforceability of the Warranty is subject to: strict compliance of Buyer with the instructions for use and maintenance of Vehicles as edicted by RT;the performance of all the service operations cited in the Vehicle driving and maintenance instructions in the authorized workshops network of RT. The corresponding services must be duly recorded in the Service and Warranty Handbook.<o:p>
The Warranty shall be implemented in the authorized workshops network of RT only, and on a Vehicle that has never been repaired or converted outside this network.<o:p>
3.Exclusions: Are formally excluded from the scope of the Warranty:<o:p>
·tyres, broken windows, light bulbs and fuses;<o:p>
.normal wear and tear of vehicle components;<o:p>
damage resulting from (i) lack of maintenance or use of lubricants or ingredients in breach of RT required specifications, (ii) faulty driving, (iii) overloading, even for a short period of time, (iv) use of equipment or modification of the Vehicle in breach of RT recommendations;<o:p>
the cost of labour incurred for the performance of recommended periodic settings so as to ensure smooth operation of the concerned Vehicle;<o:p>
costs related to maintenance of the Vehicle, including lubrication, oil change, filters and worn seals;<o:p>
staff travel or towing of the Vehicle, costs and consequences of immobilisation of the concerned Vehicle;<o:p>
force majeure, acts of God (including fire, damage caused by third-parties);<o:p>
the use and installation of replacement parts other than those provided under the responsibility of RT.<o:p>
4.By express agreement, the liability of RT resulting from a non-conformity of a Vehicle or a malfunction thereof is strictly limited to the foregoing, to the exclusion of any other warranty.<o:p>
5.In any event, should RT's liability be definitively recognized by a court of competent jurisdiction, the compensation which could be granted to Buyer shall not exceed 50% (fifty percent) of the amounts effectively paid by Buyer to RT. Buyer is required to take any reasonable steps to mitigate the potential damages it may suffer from.<o:p>
